These terms and conditions should be read and accepted by you prior to your purchase. By purchasing any of the AvatarJo services, you agree to be bound by these terms and conditions.

1. Definitions

"Agreement" means the contract you have entered into by purchasing the services to which these terms and conditions apply.
"Contract Start Date" means the date this contract is formed.
"Course" means the training services which are provided to you by AvatarJo.
"AvatarJo" refers to AvatarJo, part of ActorBank Ltd.
"Services" means the facilities, course materials and support offered to you as part of your training.
"Trade Marks" means all names, marks and logos from time to time owned by or registered in AvatarJo’s name including without limitation "AvatarJo training", or those of ActorBank.
"Website" means www.avatarjo.co.uk or any other website AvatarJo may designate.
"You"/"Yourself" means the person or company who has purchased the services.
"Pay As You Go" means clients and users who use the online booking process and pay via our online payment system.

2. Formation of Contract

The Contract Start Date is defined as the day on which you indicate your acceptance of the Training Services on offer to you. By completing the booking process, you acknowledge and accept these terms and conditions.

Subject to the "Your right to cancel or transfer" clause below, this agreement is not cancellable.

3. Your Right to Cancel or Transfer

If the Consumer Protection (Distance Selling) Regulations 2000 apply, you have the right to cancel this agreement without liability within 7 days of the appointment date, provided that services have not commenced and are not due to commence during this period.

You may cancel or change your booking up to 24 hours in advance. It is not possible to cancel or amend your booking with less than 24 hours’ notice, and no refunds are given with less than 24 hours’ notice. Cancellations should be made using the link provided in your booking confirmation email.

4. Cancellation of Training Sessions by AvatarJo

AvatarJo reserves the right to cancel a booking at any time without liability. In such cases, attendees will be offered an alternative date. AvatarJo is not liable for any expenses incurred.

5. Termination

AvatarJo may terminate the provision of any part of the services or restrict your access to services without prior notice where:

5.1 there is a regulatory or statutory change limiting AvatarJo’s ability to provide the services;
5.2 any event beyond AvatarJo’s reasonable control prevents AvatarJo from continuing to provide the services. AvatarJo will use reasonable endeavours to find a solution by which its obligations may still be performed.

6. Payments

Bookings made by Pay As You Go clients must be paid via PayPal, unless otherwise agreed in advance.
Any refunds agreed by AvatarJo will be processed within 28 working days of the agreement date.

7. Prices

Prices quoted on the website are correct at the date of publication and remain valid for 30 days. AvatarJo reserves the right to adjust prices outside of this period.

8. Services Updates

AvatarJo reserves the right to amend, modify, or improve the content and format of any service (in whole or in part) at any time in line with industry developments or to improve the quality of service delivery.

9. Acceptable Use Policy

You agree to abide by all applicable laws and regulations and ensure that any material uploaded, distributed, or stored by you does not infringe the rights of others.

10. Code of Conduct

You shall use the services strictly in accordance with these terms and shall not misuse the services. You must follow all reasonable instructions provided by AvatarJo in connection with service use.

In accessing the services, you agree not to:

10.1 reproduce, redistribute, or commercially exploit any of the content unless expressly permitted;
10.2 remove copyright or trademark notices from any training material;
10.3 create a database by systematically downloading or storing content;
10.4 resell or commercially benefit from any part of the services;
10.5 fail to check or ensure you have appropriate IT equipment and internet connectivity for video-based services. A test link is provided by our video provider for this purpose.

11. Indemnity

You agree to indemnify and hold harmless AvatarJo and its officers, employees, and agents from and against any losses, liabilities, claims, costs or expenses resulting from your use of the services or any breach of these terms.

12. Complaints and Course Guarantee

All complaints or claims relating to AvatarJo services must be received in writing within 14 days of the session date. If a replacement session is requested, it must be scheduled within 90 days of the original date unless otherwise agreed by AvatarJo.

13. Contact AvatarJo

If you have any questions or need to contact AvatarJo, please do so in writing.

All notices or written communications must be sent by post or email. For service by email to be valid, AvatarJo must acknowledge receipt. Notices will be deemed served:

• when delivered by hand: at the time of delivery;

• when posted: 48 hours after posting;

• when emailed: upon acknowledgement of receipt by AvatarJo.

14. Special Offers

Use of any special offer or discount code is subject to the following terms:

• All offers are at AvatarJo’s discretion and may be withdrawn at any time;

• Offers and discounts cannot be applied retrospectively to an existing booking;

• You cannot cancel and rebook at a reduced rate.

15. Use of Anonymised Data for Service Development

By participating in any role-play session or training (via video or otherwise), you consent to AvatarJo recording and processing session data (including audio, video, transcripts, and feedback) for the purposes of service development, product innovation, and improving training delivery.

To protect your privacy, all data used for these purposes will be fully anonymised in accordance with the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018. Any data that could identify you directly or indirectly will be removed or irreversibly masked.

Anonymised data may be used to:

• Develop training tools and learning materials,

• Improve AI-powered or automated feedback services,

• Conduct research and analysis on communication and learning behaviours.

Your identifiable data will not be shared or published without your explicit consent. You may withdraw your consent to the use of anonymised data at any time by contacting us at [insert contact email]. Withdrawal does not affect the legality of any prior use of data based on your original consent.

16. Law

This agreement shall be governed by the laws of England and Wales. Nothing in these terms shall reduce your rights under UK law relating to the supply of services.
